I have been using Zoom Meetings to conduct remote mediations for several weeks now and am happy to report that this approach is working very well.
In addition to mediating remotely, I have also expanded my technological solutions to allow parties to digitally sign all mediation and settlement documents. For those who are interested, I am also adding electronic payment options to cut down on the work needed to process an invoice. I think larger institutional clients may be very interested in this option.
I don’t know if these “virtual” mediations represent the future of our work, and I can say that there are cases in which this method would probably not be the best path. Arbitrations would certainly be more of a challenge, but even those are now being conducted remotely. Nonetheless, finding ways to continue dispute resolution in uncertain times is important for our profession and I am sure many of you are also looking for a path forward.
